These Terms of Use ("Terms") govern your access to and use of openinteraction.com and any related pages we operate (the "Site"). The Site is operated by Open Interaction, Inc., a company registered in Delaware, United States ("Open Interaction," "OI," "we," "us," or "our").
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Scope
These Terms apply to the Site, including the model waitlist and contact forms on it. Access to OI models, hosted services, APIs, or software, when offered, will be governed by separate terms, such as the applicable OI service terms, which will be presented to you when you sign up. If these Terms conflict with those separate terms, the separate terms control for the relevant service.
2. Use of the Site
You may use the Site for lawful purposes and in accordance with these Terms. You agree not to:
- attempt to gain unauthorized access to the Site or the systems behind it;
- interfere with or disrupt the Site, including through denial-of-service attacks, malware, or excessive automated requests;
- scrape, crawl, or copy Site content at scale by automated means, except as permitted by our robots.txt or for search-engine indexing;
- submit false information, or sign up other people without their permission, through any form on the Site;
- use the Site to impersonate OI or any other person, or to misrepresent your affiliation with OI;
- use the Site in violation of any applicable law or regulation.
3. Waitlist and Early Access
Model families shown on the Site as "Coming soon" are not yet generally available. When you join the waitlist:
- you are asking us to contact you about access to the model families you select;
- joining does not guarantee access, a date, or any particular features, pricing, or terms;
- we may invite people from the waitlist in any order, including based on use case, region, or capacity;
- any access we later grant will be subject to the terms presented at that time.
You can leave the waitlist at any time by using the unsubscribe link in our emails where available, or by contacting us at privacy@openinteraction.com.
4. Information on the Site
We provide technical information, benchmarks, and performance figures on the Site for general informational purposes. Performance depends on hardware, configuration, model, workload, and other factors, so your results may differ. Where we publish benchmark results, we describe the conditions next to them.
Features, models, model identifiers, code samples, and specifications described on the Site, including those marked "Coming soon" or "Preview," may change or be discontinued without notice. Nothing on the Site is a commitment, warranty, or service-level guarantee.
5. Intellectual Property
The Site and its content, including text, graphics, visual design, and the software used to run the Site, are owned by or licensed to OI and are protected by intellectual property laws.
"Open Interaction," "OI," the OI logo, and related marks are trademarks of Open Interaction, Inc. You may not use them without our prior written permission, except to refer to OI and its products accurately and in a way that does not suggest endorsement.
6. Submissions and Feedback
If you submit information through the Site, such as a waitlist sign-up or a message to us, you confirm that it is accurate and that you have the right to provide it. Please don't include confidential or sensitive information in free-text fields. We handle personal information as described in our Privacy Policy.
If you send us suggestions or feedback about OI, we may use them without any obligation to you.
7. Third-Party Links and Services
The Site links to third-party websites and services, such as social networks and, when available, documentation hosting. We don't control them and are not responsible for their content, policies, or practices. Your use of third-party sites is at your own risk and subject to their terms.
8. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED USD 100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in Delaware, USA, and each party consents to personal jurisdiction there.
11. Changes
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. If you keep using the Site after changes take effect, you accept the updated Terms.
